A terroristic threat on a high school wall at DeKalb High School has led to the arrest of a juvenile student. That student, whose name was not released because of their age, has now been charged with making a terroristic threat which is a 3rd degree felony in the State of Texas.
By statute, Texas Penal Code § 12.34 states that a third-degree felony in Texas is punishable by imprisonment for a term of not more than 10 years or less than 2 years in the Texas Department of Criminal Justice and/ or a fine of up to $10,000.
Depending on the circumstances of the charge and the defendant’s criminal history, they may also be eligible for Deferred adjudication or probation for a term ranging from 2 to 10 years.
